Terms of Service

These terms govern your use of statue001.com (the “Site”) and any purchase of a piece of STATUE #001 or bid on the Heart. By using the Site or paying for a piece you agree to them.
1. Who we are
The Site is operated by the seller (“we”, “us”):

2. What you are buying
STATUE #001 is a collective digital artwork made of 50,000 numbered pieces. A piece is a digital object and a creative space inside that artwork. Buying a piece gives you a permanent, public place in the monument, recorded under your name in our database, and the right to the optional text, link and image you attach when you buy.
A piece is not an investment, a security, a financial product or a cryptocurrency token. We make no promise of profit, return, resale value or liquidity. Ownership is recorded in our database; it is not a blockchain asset, and it gives you no copyright in the statue or the Site and no ownership of anything outside the Site.
3. Prices, reservation and payment
- The price of a piece is fixed by its number, as shown on the Pricing page. Prices are in US dollars and are charged by our payment provider, Stripe. Any taxes that apply to your purchase are shown at checkout.
- When you start a checkout, the piece is reserved for you for a limited time (currently about 35 minutes). If you do not pay in time the reservation is released and the piece becomes available to others.
- A purchase is complete only when Stripe confirms your payment and we confirm it by e-mail. We never see or store your card details.
- If two people try to pay for the same piece, the first confirmed payment wins and the other payment is returned.
- All sales are final. There are no automatic or self-service refunds, and you cannot request a refund through Stripe. A refund is only ever issued manually by our administrator, at our sole discretion, as described in our Refunds & Cancellations policy, without affecting rights you have under mandatory law.
4. Your piece is permanent
Once purchased, a piece stays in the monument. The optional text, link and image must be provided at purchase and cannot be changed or added later. You confirm this at checkout. Limited exceptions are in section 7 (removal) and in our Refunds & Cancellations policy.
5. Your content
You are responsible for the text, link and image you submit. You confirm that you own it or have the right to use it, and that it does not:
- infringe anyone's copyright, trademark, privacy or other rights;
- contain hate speech, harassment, threats, sexual content involving minors, or any content that is illegal where we operate or where you live;
- contain pornography, graphic violence, malware, phishing, scams or links to sites that do;
- advertise illegal goods or services, or mislead people about who you are.
You grant us a worldwide, non-exclusive, royalty-free licence to store, process, display and reproduce your content on the Site, in the 3D monument, in previews and in our promotion of the project, for as long as your piece is part of the monument. You keep all other rights in your content.
6. The Heart (piece #50,001)
Piece #50,001 is not sold at a fixed price. When the 50,000th other piece has been claimed, it is offered at auction:
- The auction opens automatically and runs for seven days. Everyone who owns a piece is notified by e-mail.
- To bid you must confirm your e-mail address. A bid must be at least the current highest bid plus the minimum increment shown on the auction page. A bid is a binding offer and cannot be withdrawn.
- When bidding closes, the highest valid bid wins. The winner is told by e-mail and has a limited time (currently 72 hours) to pay through Stripe. If the winner does not pay in time, we may offer the Heart to the next highest bidder or run the auction again, and may block the non-paying bidder from future bids.
- The same rules about permanence, content and removal apply to the Heart as to every other piece.
We may extend, cancel or restart an auction if there is a technical fault, fraud or a manifest error, and will say so on the auction page.
7. Removal of a piece
We may remove content, or cancel a piece and put it back on sale, if it breaches these terms, the law, or Stripe's rules, if the payment is reversed or disputed, or if we cannot reasonably keep it online. If we do this, the text, link, image and owner details are deleted from the piece, we tell you by e-mail with the reason. Whether a refund is granted is decided by our administrator as described in our Refunds & Cancellations policy.
8. Acceptable use of the Site
Do not attack, overload, scrape at scale, reverse engineer or interfere with the Site, try to buy pieces with stolen payment methods, or use bots to reserve pieces. We may block access and cancel purchases that do this.
9. Availability and changes
The Site is provided “as is” and “as available”. We aim to keep it online but cannot promise uninterrupted service, and the 3D experience needs a device and browser with WebGL support. We may change or improve the Site, the viewer and these terms. Changes apply from the date shown above; the terms in force when you bought a piece continue to apply to that purchase.
10. Liability
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory consumer rights. Subject to that, we are not liable for indirect or consequential loss, loss of profit or opportunity, or for content submitted by users, and our total liability to you for any claim relating to a purchase is limited to the amount you paid for that piece.
11. Consumers in the EU / EEA / UK
If you are a consumer, you keep the mandatory rights given to you by the law of the country where you live. Your right of withdrawal for digital content is explained in our Refunds & Cancellations policy. You can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
12. Governing law
These terms are governed by the law of the country where the seller is established, without affecting the mandatory consumer protections of your country of residence. Disputes go to the competent courts of that country, unless mandatory law gives you the right to bring a claim in your home country.
